NATURE AND COMPETENCE

Nature

The National Directorate of Land, Property and Services Registration (DNTPSC) is the department responsible for establishing and administering a system of information concerning the use and ownership of property and implementation of an efficient system for managing the assets of the state.

Skills

It is the DNTPSC:

* Support the government in the management of property in the public domain and the domain of private property of the State;
* Promote the necessary steps, under the Act, initiating procedures to recover the property of the State;
* Promote the information and initiate administrative procedures to resolve conflicts of possession and ownership of property;
* Collaborate with the judicial authorities and institutions of alternative dispute resolution in the conflict of possession and ownership of property;
* Manage the property that, under the Act are considered abandoned, lost or reversed in favor of the State;
* Create a national geographic service;
* Create a national register of ownership;
* Prepare for subsequent titles to property registration in the land;
* Working as part of its mission, with the remaining officials of the Justice and other relevant entities.

ORGANIC STRUCTURE

1 - The National Directorate of Land, Property Services and Registration Directorate is composed of the District and the following Departments:

* Department of Administration;
* Department of Registration of Securities Disputes and the Earth;
* Department of Registration, Evaluation and Information;
* Department of Real Estate Administration of the State;
* Department of Land Management and Development of Spatial Data;

2 - The powers of the Department may be delegated to organizational units directly subordinate to the Head of Department, where a volume of work or a complexity that warrants.

National Director

The National Director:

* Leading the National Directorate of Land, Properties and Registration Services in implementing the policy of land and properties;
* Develop the strategic plan of the National Directorate of Land, Properties and Registration Services, taking into account the current responsibilities and the services to be provided in future by the Directorate;
* Exercise the supervision of the activities of all Departments or Regional and District Directorates, ensuring the coordination of work;
* Celebrate the special lease contracts and the addenda to the renewal of contracts and leases of transmission of the position of the tenant;
* Ensure the transparency and quality of services provided by DNTPSC and improving the quality of services provided by District and Regional Directorates and coordination with DNTPSC in Dili;
* Meeting on a regular basis with the Heads of District Directorates to plan coordination with DNTPSC in Dili;
* Present the program of activities to the Minister of Justice, according to the legislative measures and policies adopted by the Ministry in the areas of land, property and cadastral services;
* Provide regular report of activities of DNTPSC to the Minister of Justice.
* Propose the appointment of heads of department and district directors;
* To perform all the other powers conferred upon it by law or delegated by the Minister of Justice

District Director

1 - The District Director of the Directorate.

* Ensure the implementation of the powers of the District Directorate;
* Coordinate activities with the District Directorate of the National Director;
* Develop the Directorate's business plan and present the District's budget to National Director;
* Provide regular report of activities to the National Director;
* Ensure the efficiency and transparency of the administration of Directorate District;
* To perform all the other powers conferred upon it by law or delegated by the National Director;

2 - The office of District Director is equivalent to the post of Head of Department, under and in accordance with the law.

Powers of the Head of Department

The Head of Department:

* Ensure and oversee the implementation of powers of the Department;
* Develop an action plan in collaboration with the other Heads of Department and the National Director;
* Provide regular report of activities to the National Director;

Central Services

Department of Administration

1 - The Department of Administration is the department responsible for administering the business and human resources management, financial, logistical and information of DNTPSC.

* Organize all hours of the office, ensuring the receipt, registration and classification;

* Prepare the requisition of funds from budget allocations;

Department of Registration of Land Titles and Disputes

1 - The Department of Registration of Land Titles and disputes is the service responsible for the identification of property and management mechanisms for resolving disputes about the possession or ownership of property.

2 - It is, namely, the Department of Registration of Land Titles and Disputes:

* Undertake the registration of assignment of property rights;
* Make the registration of immovable property of the State;
* Ensure the registration of all the acts that by law should be recorded;
* Ensure the endorsement of all the acts that by law must be entered to the register;
* Ensuring the legitimacy and suitability of the acts of registration and settlement;
* Prepare and issue the certificates provided for by law;
* Develop and provide the public information about real estate as well as the certificates that prove the information in the database of the national register of immovable property;
* Provide assistance to the public on issues relating to registration and endorsements;
* Coordinate with the Registration Department of the exchange of relevant information to the registry;
* Provide assistance to the public, providing information regarding the status of claims, its processing and the claimants to receive documentation of claims,
* Promote the sorting and preparing the documents for each claim;
* Facilitate coordination with other departments of government or judicial authorities for the delivery of relevant issues with the registration, or exchange of information relating to complaints.
* Implement the measures necessary to resolve conflicts of possession and ownership of property in possession of individuals;
* Promote the mediation between the conflicting parties in the process of complaint;
Develop together with the parties, the terms of the Mediation Agreement;
* Create and maintain an information system on the allotment of securities, obtained through mediation agreements;
* Exercise the supervision of the activities of District Directorates of mediation and promote training courses for district and regional officials;
* Produce reports containing information on the number of cases submitted to mediation, the percentage of disputes resolved and other relevant data;
* Support and guide the Director in response to reports of judicial and administrative complaints;
* Coordinate with the prosecutor's participation in state court proceedings involving questions of ownership or possession of property abandoned or state;
* To perform all the other powers conferred upon it by law or delegated by the National Director.

3 - The powers referred to in points a) i) of the previous paragraph are temporarily exercised by the Department of Registration of Land Titles and disputes to be provided the appropriate infrastructure to its exercise by the National Directorate of Registries and Notaries.

4 - The skills identified in subparagraphs n) r) of paragraph 2 are exercised temporarily by the Department of Registration of Land Titles and disputes to the implementation of a public institution for mediation and settlement of disputes.

Department of Registration, Evaluation and Information

1 - The Department of Registration, Evaluation and Information Service is responsible for developing and administering the register, and the evaluation of land in the national territory.

* Provide information on the property to DNTPSC departments and other government departments;
* Develop and update the request of the National Director, the tables of technical evaluation of land and buildings;
* Make an assessment of land and buildings throughout the territory;
* Develop proposals for the granting of grace periods or adjustment of the value of the rent for the leases and submit them to the Minister of Justice.

Department of Administration of the State Real Estate

1 - The Department of Real Estate Management is the department responsible for managing the property of the State and abandoned property.

2 - It is, namely, the Department of Real Estate Administration of the State:

* Develop, maintain and update, in coordination with the Directorates District, a database cataloging all the properties of the state or under its administration;
* Prepare technical reports on the properties to be rented.
* Instruct the process of allocation of property of the state bodies or government departments;
* Promote and implement the rental of property of the state or under management for residential, business, agricultural or industrial, diplomatic missions and international organizations.
* Keep a file systematic, with a database of the leases of property of the State and under management managed by the Department, including special contracts and those awarded by the District Directorates;
* Promote the settlement of citizens who illegally occupy property of the state or under its administration, through the conclusion of special contracts of lease;
* Implement a system of payment of rents from the leases of property of the state or under state administration;
* Oversee the collection of rent due and instruct the levying of fines on the rent payable under the legislation.
* Develop a database update on the situation of default;
* Issuing administrative notice of eviction to the occupants in an illegal under existing legislation.
* Promote and support in legal terms, the administrative eviction of illegal occupants of property of the state or under its administration and report on each case;
* Inform the Minister of Justice of any assistance or legal consequences concerning administrative procedures for eviction;
* Ensure the award of leases in accordance with the legislation in force;

Department of Land Management and Development of Spatial Data

1 - The Department of Land Management and Development of Spatial Data Service is responsible for certification of technical aspects in the location of land for specific use and support the delimitation of administrative boundaries and international borders;

2 - It is, namely, the Department of Land Management and Development of Spatial Data:

* Ensure the technical aspects of the location of land for specific use;
* Conduct a survey and research the change of use of land and determine its classification;
* Conduct studies space, monitoring the changes in land use and planning support for projects;
* Develop cartogram for specific purposes;
* Support Services Public Administration in the delineation of administrative boundaries and international borders;
* Ensure and promote the conservation and maintenance of the milestones established in the border lines and administrative boundaries;
* Ensure and maintain files and database geographical areas under its jurisdiction;
* Organize the national cartographic series;
* Develop and monitor the work of production of cartography and topography;
* Develop the technical standards of cartographic production;
* Issue certification to qualified professionals to the business of cartography;
* Produce, process and store geographic information in general;
* Acquire and process aerial photographs and ortofotomapas;
* Acquire and process satellite images of them to be used for mapping;
* Building a management information system metadata;
* Providing the geographical information stored;
* Coordinate with rDepartamentos of DNTPSC and other public or private institutions to obtain information relevant to the production of geographic information;
* To perform all the other powers conferred upon it by law or delegated by the National Director.
